Payment, Handing-Over, Cancellation,
Return, Warranty, & Shipping Policies
The Payment, Cancellation, Return, Warranty, Shipping and Handing-Over policies (hereinafter referred to as the “Policies”) set out, together with the Terms of Use, Privacy Policy and Cookie Use Policy, all the terms and conditions applicable when you purchase from Silvazar® via its website www.silvazar.com, hereinafter referred to as the “Site”. This Policy is legally binding between you as a beneficiary of the Services or as a user of the Website (hereinafter referred to as “you”, “buyer”, “customer” or “user”) and the Silvazar® entity (hereinafter referred to as “we” or “us” or “our” or Silvazar®).
1- Payment Policy:
A. When checking out, you pay the full amount of the invoice, which includes the value of the product, the shipping fees as specified by the shipping company, the value-added tax (VAT) and any other fees that may be imposed by the local authorities or the authorities of the country to which the product will be shipped.
B. The payment options offered on the Site are the only options offered by Silvazar® for the payment of its products.
C. You shall pay VAT based on the country of origin of the payment method or as the regulations expressly dictate.
2- Handing-Over Policy:
A. Whatever the reasons, since all of our products are made of silver, gold and/or precious stones, the product is delivered to the buyer personally.
B. If for some reason you expect that you will not be available at the time of delivery of the product and you want someone to receive the shipment on your behalf, you must give Silvazar® and the shipping company permission to deliver the product to that person in the event you are not available, by mentioning the recipient’s name, mobile number and email on the shipping form so that the shipping company can contact the recipient and verify his/her identity.
C. You acknowledge that you release Silvazar® from any responsibility towards you or towards any third party in the event that the data you have entered is incomplete or inaccurate; or in the event you authorize someone else to receive the shipment but he/she fails to receive it, which may eventually result in the returning of the shipment to Silvazar® and in you paying an additional shipping fee and insurance policy fee for the product to be shipped back to you; or in the event the recipient disposes of the shipment at will.
3- Cancellation and Return Policy:
A. You can cancel the order and get a full refund of the amount paid as long as the purchased product has not yet been shipped. You can check the status of the order by logging into your account and then to Order History. If you have more than one purchase order, use the invoice reference number to find out the status of the order. Click on the Cancel Order button and then confirm the cancellation and you will receive an email confirming the cancellation of the order. The process of refunding the amount will be exclusively to the card used for the payment and it may take from five (5) to ten (10) working days for the amount to appear in the account, or according to the policies of the bank.
B. If the product has been shipped, the Cancel Order button will be deactivated and you will not be able to cancel the order.
C. After receiving the order, you may request to return the product within twenty-four (24) hours from the date of receipt as provided by the shipping company. Silvazar® bears the return shipping fees only if the product was damaged as a result of the shipping process, knowing that Silvazar® guarantees the quality of its products, the quality of the packaging and the conformity of the specifications of what is displayed on the site to what is truly shipped. Silvazar® also maintains photographs and videos of the product from packaging to delivery to the customer.
D. The product damaged in the course of shipping, once the damage is documented and proven, will be replaced with the same product that was previously ordered; you cannot replace the product with another product, whether their prices match or do not.
E. For a product to be returned, it must not have been used or replaced in whole or in part, nor must it be missing any of its components, nor has it lost its color. In addition to that, it must have the Silvazar® logo, the serial number and the QR Code used by Silvazar® against the forging and counterfeiting of its products.
F. After the lapse of twenty-four (24) hours of receiving the product as provided by the shipping company, the Return Product button will be deactivated and you will no longer be able to request returning the product.
G. Neither the product can be returned nor the payment be refunded after the lapse of twenty-four (24) hours from the time of receiving it.
H. In all cases, any amount decided by Silvazar® pursuant to the Cancellation and Return and Refund Policies will be refunded only in the same currency stated on the invoice and in the same method and to the same card.
4- Warranty Policy:
A. The layer of gold with which silver jewelry is plated ranges between five (5) and ten (10) microns, which is the highest thickness with which silver is ever plated, which makes the manufacturing cost high compared to that of other jewelry companies. Therefore, Silvazar® gives a warranty on the gold color for ten years. Silvazar® also gives a warranty on quality for lifetime or as long as Silvazar® is an existing company and has not been dissolved, liquidated or declared bankrupt.
B. The warranty does not cover misuse, mis-storage and mis-handling of the product as a delicate piece of jewelry, and Silvazar® has the right, at its own discretion and the judgment of its experts, to determine whether the piece has been misused and mis-stored.
C. The warranty expires if you replace, or appoint someone on your behalf to replace, or deposit the product with a third party to replace, a part in it, or to do welding or electroplating, or to adjust its specifications whatsoever, or if you assign a third party to do all or part of the aforementioned, or if a third party does any of the aforementioned or all of it, with or without your knowledge. The warranty also expires if Silvazar® logo, the serial number and/or the QR Code printed on each piece is/are tampered with.
D. Silvazar® pays insurance policy fees on each item shipped to you. The insurance expires once the shipment is received by you. In the event that you return the shipment within twenty-four (24) hours, as per the return Policy, Silvazar® will bear the fees of the insurance policy until the product arrives at our premises. Otherwise, the customer shall bear the fees of the insurance policy or the value of the entire product in the event that the product is lost or it does not reach the premises of Silvazar®.
E. Silvazar® undertakes to purchase Silvazar® products from you for the same amount paid at the time the purchase was made, less: (a) ten percent (10%) of the product value at the time the customer made the purchase, (b) the shipping charges, (c) insurance charges, (d) value-added tax, whereby (b), (c) & (d) as per the charges at the time of selling to Silvazar®, and (e) any fees that the authorities may impose, pursuant to the following terms and conditions:
i) You can sell Silvazar® product to Silvazar® only after twelve (12) months after the purchase (from the date of payment);
ii) You need to attach a copy of the invoice and a copy of the passport or national ID to verify that the seller is the buyer, but in the event that the seller is not the original buyer of the product, Silvazar® will communicate with the original buyer to verify that the seller of the to-be-sold product is the rightful owner at the time of selling. If the original buyer of the product is impossible to reach, Silvazar®, at its own discretion, reserves the right whether or not to accept to purchase the product.
iii) The product does not show any signs of excessive use, such as scratches and abrasions;
iv) The product is of the same weight as it was at the time of purchase as expressly stated in the invoice;
v) All genuine gemstones are present and none of them is missing or has been replaced; a competent third party, usually the specialist jewelry company that issued the certificate of authenticity of gemstones, will examine the product and verify that no piece has been replaced and that the to-be-sold product matches the original product at the time of purchase; this authority will be the decision-maker about the authenticity of the product;
vi) Presence of the Silvazar® logo in addition to the serial number and QR Code on each piece;
vii) The serial number and QR Code on each piece must match those on the certificate and on the invoice;
viii) All the foregoing in (iv), (v), (vi) and (vii) hereinabove must match Silvazar® records in terms of product description, serial number, weight, material, gemstones, type, authenticity, metal (silver or gold) and purity as well as product image in Silvazar® records.
ix) Silvazar® has not been liquidated, dissolved or sold, nor has it declared bankruptcy at the time the customer places an order to sell Silvazar® products to Silvazar®.
5- Shipping Policy:
A. In all cases, you shall bear the product shipping charges to the address provided on the Site, except in cases where Silvazar® decides, in its sole discretion, to bear the shipping costs as an option among the offers it offers from time to time.
B. Pursuant to the terms and conditions of the Warranty Policy, customers wishing to perform color maintenance or modification on products purchased from Silvazar® must pay the shipping fees to and from the customer, in addition to the insurance policy fees, which fees may vary according to the value of the product at the time of purchase so as to ensure proper compensation or replacement of the product in the event of its loss. When shipping the product to Silvazar®, you are requested to place the product in its original box before the shipping official, who will take a photo of the product in the box prior to placing it in the shipping company’s box.
